In a divorce case, Court Orders specifying how to allocate the proceeds of a Pension Plan or 401K Plan are called QDROs. QDRO stands for Qualified Domestic Relations Order. Our firm prepares these orders and gets them pre-approved by the plan administrators so that they can be signed by the Judge and executed. Our firm has been doing QDROs for may years. GENERAL INFORMATION ABOUT A QDRO
A QDRO, stands for Qualified Domestic Relations Order. It is a Court Order that is required to divide funds of a retirement plan or pension pursuant to a divorce.
QDROs have several requirements that make them qualified so that they can be accepted by the retirement plan's Plan Administrator.
Our office contacts the Plan Administrator and will send them a draft of the QDRO for pre-approval (if they pre-approve QDROs) before it is ready to be submitted to the Court for signature.
Our attorney will use his skills to draft the QDRO tailored to the client's specific circumatances and the requirements of the Final Judgment.
Please get the following information ready if you have it. Name of Plan. Type of Plan. Both parties social security numbers, addresses, dates of birth, date of divorce, date of marraige, Final Judgment and name address and phone number for Plan Administrator. If you dont have all of these, we can assiist you in getting the information.
